China Chemical Notification - China REACH
Prior to the manufacture or import of a new chemical substance, company shall undergo new chemical substance notification, apply for and receive a Registration Certificate from the Chemical Registration Centre (the CRC) of the Ministry of Environmental Protection. This is defined in the Environmental Administration of New Chemical Substances issued by the State Environmental Protection Administration (SEPA) of the People's Republic of China in 2003.
On 21 May 2009, China's Ministry of Environmental Protection launched a consultation on a proposal (the Revised Regulation) to replace current one. If adopted, the new regulation would come into force in October 2010. The revised regulation is more like EU's REACH rules and thus called "China REACH".
What does notification apply to?
China REACH would apply only to new chemical substances ¨C ie chemicals other than the approximately 45,000 substances currently listed on the Inventory of Existing Chemical Substances Produced or Imported in China (IECSC).

What is new in the revised provision (China REACH)?
- The volume and complexity of data that must be supplied to the authorities for notification is greatly increased based on a principle that "the higher the volume, the more information required";
- Data to support notification may be submitted only by Chinese-based entities in the current draft;
- Only data generated in Chinese testing laboratories will be accepted for registration in the current draft;
- Companies who wish to export new chemicals to China would have to rely on local Chinese agents to do the testing and notification;
- Companies are required to report their activities and keep their record after receiving a registration certificate. For example, a "first time activity report " must be submitted to the CRC within 30 days of the first production or transfer of a registered substance. In the case of new chemical substances of environmental concern, registrants must file similar reports each time they transfer such substances to other market actors, and processors and users must file such reports within 30 days of their first processing or use of such a substance;
Which data is required for notification in the revised provision?
- notification application form;
- a test report detailing the substance's physiochemical properties and its toxicity and eco-toxicity;
- an environmental risk assessment report;
- recommended classification and labeling; and
- Chinese Safety Data Sheets.
