China Released the Revised Version of the Measures for the Administration of Operating Licenses for Hazardous Chemicals for Public Consultation

On 9 Aug 2011, the State Administration of Work Safety (SAWS) of China released the revised version of the Measures for The Administration of Operating Licenses for Hazardous Chemicals (hereafter called “the Measures”) for public consultation. The revised version will replace the old one issued in 2002 and will enter into force on 15 Dec 2011. Relevant departments and industry are advised to submit their comments before 15 Sep 2011.

The Measures is one of the two sub-measures of the Regulations on Safe Management of Hazardous Chemicals in China published on 11 March 2011 and stipulates the detailed conditions and procedure regarding the application of operating license for hazardous chemicals in China. The other measure relates to the Measures for The Administration of Registration of Hazardous Chemicals, which is to be revised  and released soon.

The major changes of the revised measures are listed as below:

  • The scope is more clearly defined. Only chemicals listed in the Catalogue of Hazardous chemicals are affected by the Measures. Warehouse operations are also affected by the Measures;
  • The Measures no longer differentiates between type A license (for all hazardous chemicals) and type B license(for general hazardous chemicals other than highly toxic chemicals);
  • More documents are required for application of operation license, for example, proof of employment injury insurance and labour protective equipment meeting the requirements of relevant national standards;
