Articles and Substance of Very High Concern(SVHC)
Substances that are one of the following can be regarded as substances of very high concern (SVHC).
- carcinogenic, mutagenic or toxic to reproduction (CMRs);
- persistent, bio-accumulative and toxic (PBTs);
- very persistent and bio-accumulative (vPvBs);
- seriously and / or irreversibly damaging the environment or human health, as substances damaging the hormone system;
ECHA released the first candidate list of 15 SVHCs for authorization on Aug 2008 and released second SVHC candidate list on December 2009. This list is expected to include more substances in the future as Member states suggest more substances for inclusion.

Article is defined as an object which during production is given a special shape, surface or design, which determines its function to a greater degree that does its chemical composition. e.g. car, clothes, toys. Here articles suppliers mean non-EU article exporters and EU article producers.

SVHC in articles are subject to different provisions under REACH: Registration, Authorization, Notification, Communication and Restriction.
Registration
Article supplier or article importer has to register substances in articles if the substances are intended to be released during normal and reasonable foreseeable conditions of use and the total amount of the substance present in the articles with intended releases exceeds 1 tonne per year per producer or importer. For example, ink in a marker or paint in a tube needs to be registered.
Authorization
Those listed SVHC in Annex XIV of REACH will not be allowed to be used, placed on the market or imported into the EU after a date to be set unless the company is granted an authorization.
Notification (After June 2011)
Notification to ECHA is required if any SVHC in the article is present at greater than 0.1% (w/w) and the total amount exceeds 1 tonne per annum per producer or importer. The SVHC candidate list will be regularly updated from time to time.
Communication in the supply chain
If a SVHC is present in the article with a concentration above 0.1% (weight /weight), it is obliged to inform the recipients of the article along the supply chain about the chemical name(s) and how the article can be safely used. REACH further requires this information be made available within 45 days upon consumer request.
What shall article importers and suppliers do to comply with REACH?
Article suppliers shall try to avoid using any SVHC in their products and notify ECHA if it is necessary to use certain SVHC in their products. Artilce importers shall try not to buy any products that contain SVHCs with a concentration above 0.1% w/w. Both aricle suppliers and importers shall not place any products that contain any restricted substances on the EU market.

It is important to screen SVHC and restricted substances in your product to see if any SVHC on the candidate list or rescricted substance is present. If yes, further actions might need to be taken such as looking for substance substitute, notifying consumers about how the article can be safely used, preparing documents for authorization or notification.
