China SFDA Publishes A Notice to Simplify the Procedure of Changing Name and Address of Cosmetic Manufacturer and Chinese Responsible Agent

15 Nov 2012, the State Food & Drug Administration (SFDA) has issued a notice No.307-2012 to simplify the procedure of changing the name or address of cosmetic manufacturer or Chinese responsible agent provided that production site remains unchanged. The notice will come into force on 1st Feb 2013.
A company (“applicant”) who would like to update the name & address on issued approval license can submit an application form and other supporting documents to SFDA. After receiving required documents, SFDA will issue a letter of decision if the change is approved. After that applicant should take a photocopy of the letter of decision and original SFDA licenses to SFDA service centre to make the update within 3 months after the letter of decision has been issued.
Once the name or address of imported cosmetic manufacturer is changed, a new power of attorney with Chinese responsible agent shall be submitted to SFDA for record-keeping purpose.
The required documents for the update are listed as follows:
1) Domestic cosmetic manufacturers of special use cosmetics
- Application form;
- Original documents issued by local industrial and commercial administrative department or notarized copies;
- Hygiene production license;
- Statement issued by provincial FDA to prove that the production site has not changed;
2) Manufacturers of imported cosmetics
- Application form;
- Supporting document from competent authorities of production country;
- Copy of updated power of attorney;
- Copy of agreement of takeover or consolidation;
3) Chinese responsible agent
- Application form;
- Original documents issued by local industrial and commercial administrative department or notarized copies;
